1. Agreement to Terms

By accessing or using barelyfunktional.com, you agree to be bound by these Terms of Service. If you do not agree, please do not use the site. These terms apply to all visitors, including those who submit booking inquiries, make donations, or purchase merchandise.

2. Use of the Site

• Attempt to gain unauthorized access to any part of the site.
• Scrape, copy, or reproduce site content without written permission.
• Misrepresent yourself or your affiliation when submitting a booking inquiry.

3. Donations

Donations made through this site are voluntary and non-refundable. They go directly toward supporting Barely Funktional as an independent band. Donations are processed securely by Stripe and do not constitute the purchase of any goods or services. We do not provide tax receipts for donations — Barely Funktional is not a registered nonprofit.

4. Merchandise

Merch purchases are handled through our Shopify storefront and fulfilled by Printful. All sales, returns, and refunds are governed by bfunk-merch.myshopify.com policies. By purchasing, you also agree to Printful's terms of service. Prices and product availability are subject to change without notice.

5. Booking Inquiries

Submitting a booking inquiry does not constitute a confirmed booking or contract. A booking is only confirmed upon written agreement (email or signed contract) from both parties. We reserve the right to decline any booking request for any reason.

6. Intellectual Property

Barely Funktional® is a registered trademark of Barely Funktional, registered with the United States Patent and Trademark Office. All content on this site including photos, logos, graphics, and the name "BFunk" is owned by or licensed to Barely Funktional. You may not reproduce, distribute, or use our content or marks for commercial purposes without prior written permission.

7. Disclaimer of Warranties

This site is provided "as is" without warranties of any kind, express or implied. We do not warrant that the site will be uninterrupted, error-free, or free of viruses. Use of the site is at your own risk.

8. Limitation of Liability

To the fullest extent permitted by law, Barely Funktional shall not be liable for any indirect, incidental, or consequential damages arising from your use of this site or any services offered on it.

9. Governing Law

These terms are governed by the laws of the State of California, without regard to conflict of law provisions. Any disputes shall be resolved in the courts of Santa Clara County, California.
